En principi, nom\u00e9s amb la condici\u00f3 de consumidor \u00e9s aplicable la Llei de Consumidors i Usuaris.\r\n\r\nTot i aix\u00f2, <strong>la nova jurisprud\u00e8ncia del Tribunal Suprem ha obert la porta a les empreses i aut\u00f2noms a reclamar la nul\u00b7litat la cl\u00e0usula s\u00f2l<\/strong>, encara que el pr\u00e9stec s'hagi realitzat amb fins professionals o comercials. Aquesta nova doctrina es fonamenta que la <strong>Llei de Condicions Generals de la Contractaci\u00f3<\/strong> \u2013que tamb\u00e9 regula l'abusivitat de les cl\u00e0usules contractuals\u2013 preveu la seva aplicaci\u00f3 aix\u00ed mateix per a les persones jur\u00eddiques, ja que, segons l'exposici\u00f3 de motius de la llei esmentada, hi ha igualment situacions d'ab\u00fas quan els contractes se signen entre empreses. En aquest sentit ja s'ha pronunciat el Suprem en la sent\u00e8ncia de 25 de mar\u00e7 del 2019 i en la sent\u00e8ncia d'11 de mar\u00e7 del 2020; les Audi\u00e8ncies Provincials, com la de Girona a la seva sent\u00e8ncia de 19 de juliol de 2019; i multitud de jutjats de primera inst\u00e0ncia.\r\n\r\n<\/div>\r\n<\/div>\r\n<\/div>\r\n<div class=\"elementor-element elementor-element-36c681d5 elementor-widget elementor-widget-heading\" data-id=\"36c681d5\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\r\n<div class=\"elementor-widget-container\">\r\n<h3 class=\"elementor-heading-title elementor-size-default\">Qu\u00e8 s\u00f3n les Cl\u00e0usules S\u00f2l?<\/h3>\r\n<\/div>\r\n<\/div>\r\n<div class=\"elementor-element elementor-element-521becdf elementor-widget elementor-widget-text-editor\" data-id=\"521becdf\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\r\n<div class=\"elementor-widget-container\">\r\n<div class=\"elementor-text-editor elementor-clearfix\">\r\n\r\nLa <strong>cl\u00e0usula s\u00f2l<\/strong> \u00e9s una cl\u00e0usula contractual inserida en multitud de pr\u00e9stecs hipotecaris que <strong>fixa un m\u00ednim a pagar a les quotes de la hipoteca<\/strong>, encara que l'\u00edndex a qu\u00e8 estigui vinculada (per exemple, l'Euribor) sigui inferior. Per tant, sempre es pagar\u00e0 aquest inter\u00e8s.\r\n\r\nAbans i durant la crisi, moltes de les hipoteques variables que es concedien tenien aquesta cl\u00e0usula s\u00f2l, el valor del qual normalment no baixava del 3%. En conseq\u00fc\u00e8ncia, quan l'eur\u00edbor (l'\u00edndex de refer\u00e8ncia m\u00e9s utilitzat) va comen\u00e7ar a baixar, a molts hipotecats se'ls va aplicar un tipus m\u00ednim que els feia pagar m\u00e9s diners dels que haguessin abonat si no exist\u00eds aquest l\u00edmit, sense poder beneficiar-se de la caiguda d'aquest \u00edndex.\r\n\r\n<\/div>\r\n<\/div>\r\n<\/div>\r\n<div class=\"elementor-element elementor-element-7064d4d elementor-widget elementor-widget-heading\" data-id=\"7064d4d\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\r\n<div class=\"elementor-widget-container\">\r\n<h3 class=\"elementor-heading-title elementor-size-default\">Per qu\u00e8 s\u00f3n nul\u00b7les les Cl\u00e0usules S\u00f2l?<\/h3>\r\n<\/div>\r\n<\/div>\r\n<div class=\"elementor-element elementor-element-ea4d44e elementor-widget elementor-widget-text-editor\" data-id=\"ea4d44e\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\r\n<div class=\"elementor-widget-container\">\r\n<div class=\"elementor-text-editor elementor-clearfix\">\r\n\r\nCl\u00e0usula S\u00f2l Empreses Aut\u00f2noms i Particulars van ser incorporades al pr\u00e9stec hipotecari amb manca de transpar\u00e8ncia per part de les entitats banc\u00e0ries.
