Perdr\u00e9 casa meva? \u00c9s una q\u00fcesti\u00f3 controvertida i t\u00e9 diverses solucions a la via judicial.&#13;\n<\/strong><\/p>\n\n<p>En principi, la Llei Concursal no permet mantenir l&#8217;habitatge habitual, at\u00e8s que per poder sol\u00b7licitar l&#8217;exempci\u00f3 total dels deutes, cal oferir l&#8217;habitatge per al pagament als creditors.<\/p>\n\n<p>D&#8217;aquesta manera, com a norma general, en l&#8217;execuci\u00f3 del Concurs Consecutiu, es procedir\u00e0 a la venda de l&#8217;immoble per pagar als creditors. O b\u00e9 es procedir\u00e0 a la daci\u00f3 en pagament, per saldar el deute, si aquest fos hipotecari. La finalitat del concurs \u00e9s liquidar els b\u00e9ns i pagar els creditors. El que reste per pagar \u00e9s el que es pot exonerar, si es donen els requisits.<\/p>\n\n<p>Hi ha una s\u00e8rie d&#8217;excepcions. Requisits per poder mantenir la vivenda habitual:<\/p>\n\n<p>Encara que no \u00e9s la norma general, hi ha certs casos en qu\u00e8 <strong>l&#8217;habitatge es podr\u00e0 mantenir en el patrimoni del concursat.<\/strong><\/p>\n\n<p>El primer requisit \u00e9s que l&#8217;habitatge estigui afectat amb un <strong><u>pr\u00e9stec HIPOTECARI<\/u><\/strong>. <span class=\"Y2IQFc\" lang=\"ca\">En aquest cas, es podria arribar a mantenir l&#8217;habitatge en el patrimoni del concursat, sempre que s&#8217;estigui al corrent de les quotes del pr\u00e9stec, que amb la venda no es pogu\u00e9s saldar tampoc el deute existent.<\/span><\/p>\n\n<p>Si compleix aquests 3 requisits es pot sol\u00b7licitar l&#8217;exclusi\u00f3 de l&#8217;habitatge: estar empadronat, tenir hipoteca al dia, que el valor de la hipoteca sigui igual o m\u00e9s gran al preu de venda de l&#8217;immoble.<\/p>\n\n<p>O b\u00e9 que hi hagi possibilitats de posar-se al dia de pagament, o que el deutor disposi dajuda daltres persones per posar-se al dia dels pagaments de la hipoteca.<\/p>\n\n<p>Ha de quedar clar que es tracta d&#8217;una possibilitat, ja que fins i tot si es donen els sup\u00f2sits abans esmentats, quedaria a costa del que decid\u00eds el jutge.
