{"id":7614,"date":"2022-12-23T08:06:25","date_gmt":"2022-12-23T07:06:25","guid":{"rendered":"https:\/\/www.bbsabogados.com\/es-pot-obligar-un-copropietari-a-vendre\/"},"modified":"2026-03-08T20:18:24","modified_gmt":"2026-03-08T19:18:24","slug":"es-pot-obligar-un-copropietari-a-vendre","status":"publish","type":"post","link":"https:\/\/www.bbsabogados.com\/ca\/es-pot-obligar-un-copropietari-a-vendre\/","title":{"rendered":"Es pot obligar un copropietari a vendre?"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\"><strong>En aquests casos, es pot iniciar un procediment judicial de Divisi\u00f3 de Cosa Comuna.<\/strong><\/h3>\n\n<p>El dubte relatiu a si <strong>es pot obligar un copropietari a vendre<\/strong> un habitatge \u00e9s una consulta freq\u00fcent al nostre <a href=\"https:\/\/www.bbsabogados.com\/ca\/gestio-immobiliaria\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>advocats experts en Dret Inmobiliari<\/strong><\/a> casos en qu\u00e8 un dels propietaris d&#8217;un immoble no vol seguir amb la copropietat, per\u00f2 l&#8217;altre -o els altres- <strong>no vol vendre ni tampoc comprar-ne la part.<\/strong><\/p>\n\n<p>En aquest article, us explicarem que <strong>es pot obligar un copropietari a vendre<\/strong>, i la via legal per fer-ho. Com veurem, es pot sol\u00b7licitar judicialment extingir la copropietat. En el procediment judicial mateix s&#8217;establir\u00e0 com es far\u00e0 efectiu: si s&#8217;adjudicar\u00e0 l&#8217;immoble a un dels copropietaris, si es vendr\u00e0 a un tercer, o si se subhastar\u00e0. Tot i que, com veurem m\u00e9s endavant, a Catalunya normalment s&#8217;evita la subhasta.<\/p>\n\n<h4 class=\"wp-block-heading\"><strong>Cap copropietari est\u00e0 obligat a romandre a la comunitat<\/strong><\/h4>\n\n<p>Tal com preveu el <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1889-4763&amp;p=20220906&amp;tn=1#art400\" target=\"_blank\" rel=\"noreferrer noopener\">art. 400 del Codi Civil<\/a>, &#8220;<em>Cap copropietari estar\u00e0 obligat a romandre a la comunitat. Cadascun podr\u00e0 demanar en qualsevol temps que es divideixi la cosa comuna<\/em>&#8220;.<\/p>\n\n<p>En el mateix sentit, el Codi Civil de Catalunya preveu al <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2006-11130&amp;p=20211223&amp;tn=1#a55210\" target=\"_blank\" rel=\"nore 552-10&lt;\/a&gt; que \">Qualsevol cotitular pot exigir, en qualsevol moment i sense expressar-ne els motius, la divisi\u00f3 de l&#8217;objecte de la comunitat&#8221;.<\/a><\/p>\n\n<p>Per aix\u00f2 hi ha l&#8217;anomenada <strong>\u201cextinci\u00f3 de condomini\u201d que equival a dividir la cosa comuna<\/strong>. Aix\u00ed, qualsevol copropietari d&#8217;un immoble pot sol\u00b7licitar quan ho desitgi extingir la copropietat.<\/p>\n\n<h4 class=\"wp-block-heading\"><strong>Procediment de Divisi\u00f3 de Cosa Com\u00fa<\/strong>.<\/h4>\n\n<p>El copropietari que vulgui deixar de ser-ho, pot instar un <strong>procediment judicial de Divisi\u00f3 de Cosa Com\u00fa<\/strong>. \u00c9s a dir, haur\u00e0 d&#8217;interposar una <strong>demanda<\/strong> de Divisi\u00f3 de Cosa Comuna, amb advocat i procurador.<\/p>\n\n<p>Una vez que el otro copropietario contesta a la demanda, ya sea oponi\u00e9ndose a la divisi\u00f3n o allan\u00e1ndose, el Juez dictar\u00e1 <strong>Sentencia acordando la divisi\u00f3n.<\/strong><\/p>\n\n<p>Aix\u00ed mateix, molts jutjats acorden que la divisi\u00f3 efectiva es dugui a terme en el proc\u00e9s d'&#8221;execuci\u00f3 de sent\u00e8ncia&#8221;. \u00c9s a dir, un cop tinguem la sent\u00e8ncia que acorda dividir l&#8217;immoble, s&#8217;iniciar\u00e0 una altra fase on s&#8217;establir\u00e0 com es far\u00e0 efectiva.<\/p>\n\n<p>Normalment, es fixar\u00e0 pericialment el valor de mercat de l&#8217;immoble, i donar\u00e0 un termini a les parts per manifestar <strong>si tenen inter\u00e8s en la seva adjudicaci\u00f3<\/strong>. Si hi ha m\u00e9s d&#8217;un copropietari que tingui inter\u00e8s, s&#8217;adjudicar\u00e0 a qui tingui <strong>la participaci\u00f3 m\u00e9s gran.<\/strong> En cas d&#8217;inter\u00e8s i participaci\u00f3 iguals, &#8220;<em>decideix la sort<\/em>&#8220;. Aix\u00ed mateix, l&#8217;adjudicatari haur\u00e0 de pagar als altres el <strong>valor pericial de la seva participaci\u00f3.<\/strong><\/p>\n\n<p>Normalment, es fixar\u00e0 pericialment el valor de mercat de l&#8217;immoble, i donar\u00e0 un termini a les parts per manifestar <strong>si tenen inter\u00e8s en la seva adjudicaci\u00f3<\/strong>. Aix\u00ed mateix, l&#8217;adjudicatari haur\u00e0 de pagar als altres el <strong>valor pericial de la seva participaci\u00f3.<\/strong><\/p>\n\n<p>En definitiva, seguint aquest procediment de Divisi\u00f3 de Cosa Comuna, <strong>es pot obligar un copropietari a vendre<\/strong>, ja que l&#8217;\u00fanica manera d&#8217;impedir la venda seria que es vulgui adjudicar ell mateix l&#8217;immoble.<\/p>\n\n<h4 class=\"wp-block-heading\"><strong>A Catalunya sol evitar-se la Subhasta en el procediment de Divisi\u00f3 de Cosa Comuna.<\/strong><\/h4>\n\n<p>Com \u00e9s de veure, la <strong> <a href=\"https:\/\/www.bbsabogados.com\/ca\/la-subhasta-de-lhabitatge-en-cas-de-proces-divisio-de-cosa-comuna\/\" target=\"_blank\" rel=\"noreferrer noopener\">Divisi\u00f3 de Cosa Comuna del b\u00e9 s&#8217;acabi adjudicant el b\u00e9\u00a0<strong>intentant evitar la subhasta<\/strong>. A difer\u00e8ncia de la legislaci\u00f3 catalana<strong>,\u00a0a la resta de l&#8217;Estat la norma general \u00e9s procedir a la subhasta<\/strong>\u00a0directa de l&#8217;immoble.<\/a><\/strong><\/p>\n\n<p>Per tant, els copropietaris sempre poden arribar a un acord que eviti la subhasta p\u00fablica.
