Hi ha doncs una s\u00e8rie de cl\u00e0usules abusives en els contractes de lloguer. Els propietaris dels habitatges s\u00f3n els que redacten aquests contractes. L&#8217;inquil\u00ed pot reclamar que s&#8217;eliminin del contracte. &nbsp;<\/p>\r\n\r\n\r\n\r\n<h4 class=\"wp-block-heading\"><strong><u>Quines s\u00f3n les cl\u00e0usules que poden ser abusives?<\/u><\/strong><\/h4>\r\n\r\n\r\n\r\n<p>Hi ha innombrables cl\u00e0usules a la present data que han estat i s\u00f3n considerades abusives, i per tant, s&#8217;han de tenir per <strong><em>no posades<\/em><\/strong> als contractes de lloguer.<\/p> p>\r\n\r\n\r\n\r\n<p>De les m\u00e9s flagrants i evidents, destaquen:<\/p>\r\n\r\n\r\n\r\n<ul class=\"wp-block-list\" type=\"A\"><li><strong><u>Demanar mesos per avan\u00e7at dels lloguers<\/u><\/strong>. Tret que sigui pactat per les parts de forma consensuada, el propietari en cap cas no pot exigir a l&#8217;inquil\u00ed el pagament de diversos mesos de lloguer. En cas que aix\u00ed s&#8217;exigeixi al contracte, aquesta cl\u00e0usula es considerar\u00e0 no posada, i ser\u00e0 inefica\u00e7 totalment.<\/li><\/ul>\r\n\r\n\r\n\r\n<ul class=\"wp-block-list\"><li><strong><u>Exigir un temps de perman\u00e8ncia superior als 6 mesos que la Llei estableix<\/u><\/strong>. La Llei d&#8217;arrendaments urbans (LAU) estableix un termini obligatori de perman\u00e8ncia per a l&#8217;inquil\u00ed, de 6 mesos. A partir del terme esmentat, l&#8217;inquil\u00ed pot desistir del contracte, avisant amb l&#8217;antelaci\u00f3 pactada a l&#8217;arrendador. Per tant, l&#8217;exig\u00e8ncia de romandre en un termini superior als 6 mesos \u00e9s completament il\u00b7legal.<\/li><\/ul>\r\n\r\n\r\n\r\n<ul class=\"wp-block-list\"><li><strong><u>Elevar l&#8217;import de la renda per una reforma<\/u><\/strong>. En cas que l&#8217;habitatge necessiti reformes, a les quals el propietari hagi de fer front, l&#8217;import de les mateixes en cap cas no pot ser repercutit a l&#8217;inquil\u00ed. Cosa diferent seria els desperfectes per l&#8217;\u00fas mateix de la vivenda, que s\u00ed que han de ser abonades per l&#8217;inquil\u00ed, sempre que hagin estat provocades per ell.<\/li><\/ul>\r\n\r\n\r\n\r\n<ul class=\"wp-block-list\"><li><strong><u>Renunciar a les pr\u00f2rrogues obligat\u00f2ries<\/u><\/strong>. La LAU estableix una s\u00e8rie de requisits estrictes quant a les pr\u00f2rrogues obligat\u00f2ries en un contracte de lloguer de vivenda. Aix\u00ed, si s&#8217;exigeix renunciar a aquesta pr\u00f2rroga, aquesta cl\u00e0usula en cap cas no ser\u00e0 v\u00e0lida.<\/li><\/ul>\r\n\r\n\r\n\r\n<ul class=\"wp-block-list\"><li><strong><u>Preavisar el propietari amb 60 dies d&#8217;antelaci\u00f3 del desistiment del contracte<\/u><\/strong>. La llei estableix que, passats 6 mesos de l&#8217;entrada en vigor del contracte, l&#8217;inquil\u00ed podr\u00e0 desistir lliurement del contracte, amb un preav\u00eds de 30 dies d&#8217;antelaci\u00f3. Posar al contracte un temps superior, \u00e9s abusiu.<\/li><\/ul>\r\n\r\n\r\n\r\n<ul class=\"wp-block-list\"><li><strong><u>Indemnitzaci\u00f3 per ren\u00fancia anticipada per part de l&#8217;inquil\u00ed del contracte de lloguer<\/u><\/strong>. A l&#8217;article 11 es diu que es podr\u00e0 pactar al contracte una indemnitzaci\u00f3 a abonar per part de l&#8217;inquil\u00ed. Per\u00f2 aquesta ha de ser la part proporcional d&#8217;una mensualitat en relaci\u00f3 amb all\u00f2 que resta per complir. Aix\u00ed, per exemple, obligar a abonar UNA ANUALITAT completa seria il\u00b7legal.<\/li><\/ul>\r\n\r\n\r\n\r\n<ul class=\"wp-block-list\"><li><strong><u>Permetre a l&#8217;arrendador entrar a l&#8217;habitatge quan vulgui<\/u><\/strong>. La LAU estableix la inviolabilitat del domicili. No, el propietari no hi pot entrar quan vulgui. Article 18 de la Constituci\u00f3 Espanyola.<\/li><\/ul>\r\n\r\n\r\n\r\n<ul class=\"wp-block-list\"><li><strong><u>Actualitzar la renda per sobre de l&#8217;IPC<\/u><\/strong>. Qualsevol actualitzaci\u00f3 de la renda per sobre de l&#8217;IPC \u00e9s abusiu.<\/li><\/ul>\r\n\r\n\r\n\r\n<p><\/p>\r\n\r\n\r\n\r\n<p>Finalment, fer un darrer esment a una altra cl\u00e0usula que \u00e9s molt com\u00fa. La cl\u00e0usula sobre la tinen\u00e7a de <strong>ANIMALS<\/strong> a l&#8217;habitatge. Aquesta cl\u00e0usula, cal dir que \u00e9s perfectament LEGAL.
